Terms and Conditions of Use – myCareShield

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and myCareShield, operated by MyCareShield Inc., governing your use of the myCareShield mobile application , its website and related services (collectively, the “Service”).

Please read these Terms carefully. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

To use the myCareShield app:

You must be at least 18 years old or have consent from a parent or legal guardian.
You must have the legal capacity to enter into binding contracts.
You agree to comply with these Terms and all applicable laws.

2. Description of Services

myCareShield provides a mobile-based platform that enables:

Senior safety monitoring, including fall detection and inactivity alerts.
Emergency alert dispatching to configured contacts.
Remote wellness tracking by integrating with third-party platforms such as:
- Samsung Health (via privileged partnership)
- Terra API, for data from wearables (e.g., Fitbit, Garmin, Oura)

The Service is not a medical device and does not replace professional healthcare advice or emergency response systems.

3. User Account and Responsibilities

You must provide accurate and complete information when creating an account.
You are responsible for maintaining the confidentiality of your login credentials.
You agree not to use another person’s account or share your credentials.
You are responsible for all activities under your account.

4. Consent to Use Health and Wellness Data

By using the Service, you explicitly consent to the collection and processing of your non-medical health and wellness data, including:

Heart rate, sleep data, steps, oxygen levels, etc.
Sourced via APIs from Samsung Health and Terra API

You acknowledge that:

Such data is used for wellness insights, alerts, and caregiver notifications.
We do not make clinical or diagnostic decisions based on this data.
You may revoke access at any time through in-app permissions.

5. Emergency Response Disclaimer

While myCareShield provides safety alerts to designated contacts, it:

Does not connect directly with emergency services (e.g., 112/911) unless explicitly integrated in future versions.
Is not liable for failure to deliver alerts due to device limitations, network issues, or misconfiguration.

Always seek professional emergency assistance when needed.

6. Device Permissions and Location Access

To function effectively, the app may request access to:

Device sensors (e.g., accelerometer, gyroscope, location, battery)
Background location tracking
Health data (with permission)

You are responsible for granting or revoking permissions via your device settings.

7. Acceptable Use Policy

You agree not to:

Use the app for any unlawful or fraudulent activity
Tamper, reverse-engineer, or compromise the system or servers
Interfere with other users or violate privacy
Share offensive, defamatory, or harmful content via our services

Violation may result in account suspension or termination.

8. Intellectual Property

All content, design, branding, and software used in the Service are the intellectual property of myCareShield or its licensors. You may not:

Copy, distribute, or modify the app or its content
Use our logos or materials without written consent

9. Payment and Subscription Terms

If the Service includes paid features:

Pricing and subscription terms will be clearly outlined
You authorize recurring billing if applicable
Free trial or basic tiers may be offered with limited features

No refunds are issued once a subscription period has started, except as required by law.

10. Third-Party Integrations

The app uses:

Samsung Health and Terra API to access user wellness data from wearables.
You agree to be bound by their respective privacy policies and terms of service.
We are not responsible for data accuracy or availability on third-party platforms.

12. Termination and Suspension

You may discontinue use or delete your account at any time by going to site mycareshield.com member login page and click 'Delete My Account button' to request your account deletion.

13. Limitation of Liability

To the maximum extent permitted by law:

myCareShield is not liable for any indirect, incidental, or consequential damages
We are not responsible for any health outcome, emergency, or failure to alert
Our liability in all cases is limited to the amount paid by you (if any) for the use of the Service in the past 12 months

14. Indemnification

You agree to indemnify and hold harmless myCareShield, its officers, employees, and partners from any claims, liabilities, losses, or expenses arising out of your use of the Service or violation of these Terms.

15. Modifications to the Terms

We may update these Terms from time to time. Material changes will be notified via in-app message or email. Continued use of the Service after updates constitutes your acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by the laws of:

India (if you reside or use the app primarily in India)
United States (Massachusetts) (for users based in the U.S.)

Disputes shall be subject to the exclusive jurisdiction of the courts in the respective jurisdiction.
